Avo places great importance on your privacy. Therefore, we only process data that we need for the (improvement of) our services and handle the information we have collected about you and your use of our services with care. We never share your data with third parties for commercial purposes. This privacy policy applies to the use of the website and the services provided by Avo. The effective date of these terms is 07.05.2024, and the validity of all previous versions expires with the publication of a new version. This privacy policy describes what data we collect about you, how we use that data, and under what conditions we may share it with third parties. We also explain how we store your data, how we protect it from misuse, and what rights you have concerning the personal data you provide us. Avo.com

Our webshop was developed with software from Shopify. Personal data that you provide us for our services is shared with this party. Shopify has access to your data to provide us with technical support but will never use your data for other purposes. Based on the agreement we have with them, Shopify is required to take appropriate security measures. Shopify uses cookies to collect technical information about your use of the software; no personal data is collected and/or stored.

Shopify

We use web hosting and email services from Shopify. Shopify processes personal data on our behalf and does not use your data for its own purposes. However, this party may collect metadata about the use of the services. These are not personal data. Shopify has taken appropriate technical and organizational measures to prevent the loss and unauthorized use of your personal data. Based on the agreement, Shopify is obliged to maintain confidentiality. Regular business email communication is conducted through the services of Shopify. This party has taken appropriate technical and organizational measures to prevent misuse, loss, and corruption of your and our data. Shopify does not have access to our mailbox, and we handle all our email communication confidentially.

Shipping and Logistics

When you place an order with us, it is our responsibility to deliver your package to you. We use the services of DHL for deliveries. Therefore, we need to share your name, address, and residence details with DHL. DHL uses this data only for the purpose of fulfilling the contract. In the event that DHL engages subcontractors, DHL will also share your data with these parties.

General Purpose of Processing

We use your data solely for the purpose of our services. This means that the purpose of processing is always directly related to the order you place. We do not use your data for (targeted) marketing. If you share data with us and we use this data to contact you at a later date - other than at your request - we will explicitly ask for your consent. Your data will not be shared with third parties, except for accounting and other administrative obligations. These third parties are all bound to confidentiality based on the agreement between them and us or an oath or legal obligation.

Automatically Collected Data

Data automatically collected by our website is processed with the aim of further improving our services. This data (e.g., your IP address, web browser, and operating system) is not personal data.

Collaboration in Tax and Criminal Investigations

In certain cases, Avo may be required by law to share your data in connection with tax or criminal investigations by authorities. In such a case, we are obliged to share your data, but we will oppose it within the limits of the law.

Retention Periods

We retain your data as long as you are a customer of ours. This means we keep your customer profile until you inform us that you no longer wish to use our services. If you inform us of this, we will also consider it a request to forget. This also means that we do not retain your data for more than two years after the last contact moment or transaction unless there is a legal justification for it. Due to applicable administrative obligations, we must retain invoices containing your (personal) data, so we retain this data for as long as the applicable term runs. Employees, however, no longer have access to your customer profile and the documents we have produced as a result of your order.

Your Rights

Under applicable Dutch and European law, you, as the data subject, have certain rights concerning the personal data processed by us or on our behalf. Below we explain what these rights are and how you can exercise them. In principle, to prevent misuse, we will send copies and transcripts of your data only to your already known email address. If you wish to receive the data at another email address or, for example, by post, we will ask you to provide proof of identity. We keep records of completed requests and manage anonymized data in case of a forget request. You will receive all copies and transcripts of the data in the machine-readable data format that we use in our systems. You always have the right to file a complaint with the Dutch Data Protection Authority if you suspect that we misuse your personal data.

You always have the right to view the data that we process or have processed and that relates to your person or can be traced back to you. You can make a request to that effect to our data protection officer. You will receive a response to your request within 30 days. If your request is granted, we will send you a copy of all data along with an overview of the processors who hold this data, specifying the category under which we have stored this data.

You can make a request to that effect to our data protection officer. You will receive a response to your request within 30 days. If your request is granted, we will send you a confirmation that the data has been adjusted at the email address known to us.

Right to Restrict Processing

You always have the right to limit the data we process or have processed that relates to your person or can be traced back to you. You can make a request to that effect to our data protection officer. You will receive a response to your request within 30 days. If your request is granted, we will send you a confirmation at the email address known to us that the data will no longer be processed until you lift the restriction.

Right to Data Portability

You always have the right to have the data we process or have processed that relates to your person or can be traced back to you transferred to another party. You can make a request to that effect to our data protection officer. You will receive a response to your request within 30 days. If your request is granted, we will send you copies or transcripts of all data about you that we have processed or that have been processed on our behalf by other processors or third parties to the email address known to us. In such a case, we will likely no longer be able to continue the service, as the secure linking of data files can no longer be guaranteed.

Right to Object and Other Rights

In certain cases, you have the right to object to the processing of your personal data by or on behalf of Avo. If you object, we will immediately stop the data processing until your objection is handled. If your objection is well-founded, we will provide you with copies and/or transcripts of the data we process or have processed and then permanently stop the processing. You also have the right not to be subject to automated individual decision-making or profiling. We do not process your data in a way that this right applies. If you believe this is the case, please contact our data protection officer.
